The Lease Agreement:
The time-limited lease agreement for the rental property is concluded between you as the tenant and Bessis Immobilien Mourad Bessis. The subject of the agreement is the temporary transfer of use of a rental property for residential purposes.
1. The tenant can withdraw from the lease at any time or provide a replacement tenant. The declaration of withdrawal or replacement tenant is effective from the day it is received by the landlord (host sounds like an invitation, i.e. free). To avoid future disagreements, written form (letter, fax, email) is strongly recommended! No costs will be incurred by the tenant for a withdrawal up to 12 weeks before the start of the rental period. If a rental advance payment has already been made, this amount will be refunded. For a withdrawal after the 11th week before the start of the rental period, the host can request a reasonable compensation from the tenant in accordance with § 651 j BGB.
The compensation claim is as follows:
a.) Withdrawal from 12 to 8 weeks before the rental start date: 20% of the rental price
b) Withdrawal from 8 to 4 weeks before the rental start date: 50% of the rental price
c) Withdrawal from 4 to 2 weeks before the rental start date: 80% of the rental price
d) Withdrawal from 2 weeks before the rental start date or no-show: 100% of the rental price.
Complaints must be reported to the landlord immediately or within 24 hours. The landlord will strive to address the issues within a reasonable period.
The tenant agrees to protect the rented premises and inventory from damage and to return them with all keys and accessories according to the inventory list at the end of the rental period. Damaged or unusable items must be replaced in such a way that no disadvantage is caused to the landlord.
The tenant further agrees not to make any harmful modifications to the rental property or the inventory, to report anything that seems damaged or harmful to the landlord without delay, and not to sublet the property, either in whole or in part. The property may only be occupied by those persons listed below.
Legal effect of electronic media: The management reserves the right not to recognize claims arising from the misuse of the website, email data, or email addresses.
Self-inflicted damage to the house or inventory is the responsibility of the tenant. Missing items according to the inventory list must be reimbursed at the tenant's expense. No items that may cause blockages should be thrown into toilets or sewage systems.
Smoking is not allowed in the apartment. The wood stove may not be used as it is a decorative item. Pets are not allowed in the apartment unless explicitly approved in writing by the landlord. This may result in a negotiable lease agreement. Telephone and other expenses will be settled at the end of the rental period.
Disputes arising from this contract will be subject to the jurisdiction of the location of the rental property. German law is applicable.
